Special Education Identification Process

four elementary school students standing in front of chalkboardThe Special Education Identification Process and Individual Education Plan (IEP) Process were developed by the Nebraska Department of Education – Office of Special Education. The Special Education Identification Process provides an overview of the primary actions or steps which occur when evaluating a student to determine whether he or she has a disability eligible for services under Section 504 of the Rehabilitation Act or qualifies for special education and related services under the Individuals with Disabilities Education Act (IDEA).

As provided in Nebraska Department of Education's "Rule 51: Regulations and Standards for Special Education Programs", the student is first referred to the school's Student Assistance Team (SAT), 504 Team or comparable problem-solving team for an evaluation. The SAT identifies problem-solving strategies, interventions and/or accommodations to be used by a teacher in the general education classroom to assist the student succeed academically. If the student's academic performance does not improve and all viable alternatives have been explored, he or she may be referred to the school's Multidisciplinary Team (MDT) for further evaluation to determine special education eligibility under IDEA.

Individual Education Plan (IEP) Process

Once a student has been identified as having a disability eligible for special education and related services under IDEA, an Individual Education Plan is developed by the school's IEP Team. The Individual Education Plan Process illustrates the primary actions or steps which occur during development of the IEP and provision of special education and related services to the student.
